Terms of Service for Public Events
1. Definitions
In these terms and conditions:
we, us or our means Wheely Fun Club
you or your means the person booking our Services and responsible for payment
Equipment means all equipment, materials, clothing, toys and property owned by us and used in the provision of Services
our website means www.wheelyfunclub.co.uk
Services means the children’s play session hosted by us
Session means a designated time slot for the performance of the Services by us, lasting for one hour or as otherwise advertised
2. Entering into a Contract
2.1 A legally binding contract will come into effect when:
2.1.1 you make a booking on our website. The contract is formed on the date of booking; or
2.1.2 you and we agree orally. The contract is formed on the date of our oral agreement.
2.2 Please read these terms carefully before booking. If you have questions, contact us.
2.3 You should keep a copy of these terms for your records.
3. Providing the Services
3.1 Once a contract is in place, you are entitled to attend the Session you have booked.
3.2 We aim to provide Services:
3.2.1 using reasonable care and skill
3.2.2 in compliance with commonly accepted industry standards
3.2.3 in compliance with all applicable laws and regulations
4. The Premises
4.1 We will provide Services at the location stated in your booking.
4.2 You are responsible for checking venue details before booking. We are not liable for booking errors you make.
5. Timing
5.1 If we cannot perform the Services:
5.1.1 you may either attend another Session free of charge or cancel the booking for a full refund.
5.2 If you cannot attend a Session:
5.2.1 bookings are non refundable except as stated in clause 5.1.1. With at least three days written notice, you may transfer to another Session if space allows.
5.2.2 The Consumer Contracts Regulations 2013 do not apply.
5.3 Force Majeure
We are not liable for failure to perform due to events beyond our reasonable control including extreme weather, venue closure, staff illness, strikes, epidemics, or government restrictions.
6. Price and Payment
6.1 Charges
6.1.1 our charges per Session are shown on our booking website
6.2 Payment
6.2.1 payment in full is required at the time of booking. Attendance is not permitted without advance payment.
7. Your Obligations
7.1 Supervision and Conduct
While attending a Session, you must:
7.1.1 co operate with us in all matters
7.1.2 comply with all laws, venue rules and instructions
7.1.3 supervise your children at all times. Our staff are facilitators and entertainers, not childcare providers
7.1.4 ensure children do not eat or drink near Equipment
7.1.5 refrain from attending if you or your children are unwell
7.1.6 look after personal belongings. We are not liable for loss, theft or damage
7.1.7 seek consent before taking photographs or videos of others and use such images only for personal purposes
7.2 Medical Conditions and Consent
7.2.1 You must disclose relevant medical conditions, allergies, disabilities or additional needs in advance
7.2.2 By attending, you consent to your child’s participation in active play which carries inherent risks such as bumps, slips and minor falls
7.2.3 We are not liable for issues arising from undisclosed conditions or failure to follow instructions
7.3 Behaviour
We reserve the right to remove disruptive, unsafe or abusive participants without refund.
7.4 Damage
You are responsible for any damage caused by you or your children to Equipment, venues or third party property.
8. Our Obligations
We shall:
8.1.1 ensure Equipment meets safety standards
8.1.2 comply with health and safety laws
8.1.3 clean Equipment after every use
8.1.4 limit Sessions to a maximum of 30 children
8.1.5 ensure a Wheely Fun Club representative is present throughout each Session
9. Medical Conditions and First Aid
9.1 Disclosure
You must notify us of any medical conditions, allergies, disabilities or special needs affecting your child.
9.2 First Aid Training
We strongly encourage our staff to hold paediatric first aid certification. However we cannot guarantee that every staff member present at a Session will hold a current first aid certificate. You must ensure that at least one responsible adult attending with your child is able to respond to medical situations if needed.
9.3 Voluntary First Aid
If first aid assistance is provided by our staff, it is voluntary and limited to basic support such as plasters, wipes, cold packs or comfort until a parent or guardian takes over. Our staff are not medical professionals and do not provide medical treatment.
9.4 Parent Responsibility
Parents and guardians remain fully responsible for supervising their children, making medical decisions and monitoring their child after any incident. Accepting first aid assistance from our staff does not create any medical duty of care beyond taking reasonable steps to assist.
9.5 Liability
We do not accept liability for any outcome related to first aid assistance except where the law does not allow exclusion of liability for negligence.
10. Limitation of Liability
10.1 We do not exclude liability for negligence causing death or personal injury.
10.2 Otherwise, liability is limited to reasonably foreseeable loss. We are not liable for indirect or consequential loss.
10.3 Public liability insurance cover is in place up to £1,000,000. Liability is capped at this amount where applicable, or £5,000 otherwise.
10.4 We do not provide personal accident, medical or travel insurance. Parents should arrange their own cover.
11. Marketing and Photography
11.1 We may occasionally take photographs or videos for promotional purposes.
11.2 We will only use images of your child with your prior written consent, which may be withdrawn at any time.
12. Our Right to Refuse Entry
We may refuse entry if:
12.1.1 you or your child appear unwell
12.1.2 you attend without a child
12.1.3 you appear under the influence of drugs or alcohol
12.1.4 you have not booked and paid in advance

14. Amendments to Terms
14.1 We may amend these terms where:
14.1.1 required by law or regulation
14.1.2 needed to correct minor errors that do not materially affect the contract
14.2 Notice of amendments will be given at least 15 days in advance unless the contract has ended.
15. Data Protection
We are committed to protecting your personal information. Our Privacy Notice on our website or available upon request explains how we collect, use and protect your data in line with GDPR.
16. Notices
16.1 Notices to us must be sent to info@wheelyfunclub.co.uk marked for the attention of Kat Sackett.
16.2 Notices to you will be sent to the contact details you provided at booking.
17. Third Party Rights
This contract does not give rights to any third party under the Contracts Rights of Third Parties Act 1999.
18. Loyalty Card Terms and Conditions
18.1 Wheely Fun Club offers a loyalty card scheme to reward repeat attendance.
18.2 One stamp is awarded for each standard Session attended.
18.3 After six stamps, the customer is entitled to one standard Session free of charge.
18.4 To redeem, the customer must:
18.4.1 email a clear photo of the completed card to info@wheelyfunclub.co.uk
18.4.2 provide details of the Session they wish to attend
18.5 On verification, we will confirm the booking and add the customer to that Session.
18.6 The reward is valid for standard Sessions only and cannot be applied to premium Sessions such as Halloween or Christmas events.
18.7 Customers may use the reward for a premium Session by paying the difference in price.
18.8 Loyalty cards are non transferable, hold no cash value and may only be redeemed by the person who earned the stamps.
18.9 We reserve the right to amend or withdraw the scheme at any time.
19. Law and Jurisdiction
This contract is governed by the laws of England. You and we agree that the courts of England have exclusive jurisdiction over any disputes.
20. Franchisee Operation
Events are delivered by independently operated local Wheely Fun Club franchisees. Wheely Fun Club Ltd acts solely as a booking agent for the event operator. The contract for the event is between you and the franchisee named on your booking confirmation, and the service is supplied by that operator. Payments are collected by Wheely Fun Club Ltd on behalf of the franchisee.
